Description

New policies/procedures will be subject to a review date of no more than 1 year from the date of first issue. If you still need to take matters further, you could make a claim to an employment tribunal. You can’t do this without going through Acas early conciliation first. There's a 3 month time limit for going through conciliation. This starts from the date your employer didn't allow you rest breaks. Signed (Director of Acute Services / Executive Director / Health & Social Care Partnership General Manager): …..…………………… The provision of compensatory rest does not negate a Line Manager’s responsibility for ensuring that staff who are entitled to receive an in-work rest break receive such a break.

A worker has a standard working week of 37.5 hours and does overtime of 20 hours a week for the first 10 weeks of the 17 week reference period. No leave is taken during the reference period. For the purposes of this agreement the leave year runs from 1 April until 31 March in each year, unless otherwise agreed within an employee’s contract of employment or in the case of bank employments. The entitlement to Working Time Regulation annual leave is described in more detail within NHS Circulars PCS(AfC)2008/12, PCS(AfC)2009/1, PCS(AfC)2009/4 and the associated questions and answers, CEL(2011)15, DL(2017) 4, PCS(AfC) 2019/6, DL (2020)9 and DL(2021)03 If a young worker is required to work more than four and a half-hours at a time, then they are entitled to a break of 30 minutes. A young worker is also entitled to twelve uninterrupted hours in each 24-hour period in which they work. Both these entitlements can only be altered or excluded in exceptional circumstances. Young workers are also entitled to 2 days off each week and this cannot be averaged over 2 weeks.

For the purposes of the agreement, night-time is a period of at least seven hours which includes the period from midnight to 5.00 am. A night worker is someone who is classed as working for at least three hours daily during night-time hours as a “normal course”. Employers should ensure that the “normal hours” of their night workers do not exceed an average of eight hours per 24 hours over a 17 week period. The purpose of this policy is to set out the arrangements and processes for ensuring NHS Fife's compliance with the Working Time Directive and Regulations. Very generally, researchers have found that achieving 6-7 hours of sleep per night correlates with a number of positive health outcomes, but there are also many other factors that may affect these outcomes. During sleep, the brain expends significantly less energy than it does when a person is awake, particularly during non-REM (rapid eye movement) sleep. REM sleep is a type of sleep characterized by a number of aspects, including the eye movements it is named for, virtual paralysis of the body, and the occurrence of dreams. Non-REM and REM sleep are two categories of sleep that are vastly different.Note that in any case where you need to borrow, if the next highest unit is 0 then borrow from the 2nd highest unit. Just as you would in long subtraction, borrow from the next highest place value. Subtracting Time Example Problem Doctors and Dentists, including Doctors and Dentists in training have been covered by the provisions of this agreement since 2009 (see CEL 14 (2009) However, it is still possible for Doctors to work longer hours by signing an opt-out clause. Working patterns for junior Doctors, Dentists and GP Trainees must also comply with the New Deal for Doctors in Training which was introduced in 1991 to look at reducing the number of hours worked or on duty by junior Doctors, Dentists and GP trainees in hospitals.
